There are no warranties, express or implied, made by STOW hereunder on products manufactured or distributed by it except the warranty against defects in materials and workmanship on new products to the original purchaser, as hereinafter set forth. STOW warrants products manufactured by it to be free from defects in material and workmanship under normal and proper use and servicing for the periods specified. Warranty on the engines supplied with the equipment is limited to the warranty extended by the engine manufacturer. STOW’s sole obligation under this warranty is limited to the replacement or repair, at its designated facility, of only the part or parts thereof as shall appear to STOW upon inspection to have been defective in material and workmanship. A statement giving model and serial number of the product, date of sale to original purchaser and date and description of failure shall accompany all parts. Any part or parts determined by STOW to be defective will be replaced free of charge, F.O.B. STOW facility. Parts subject to warranty must be reported to STOW within 30 days from the date the part or parts were determined to be defective. Upon request, parts must be returned to STOW for evaluation. Such requests by STOW will be made within 90 days of receiving the defective report. This warranty does not apply to any part or parts that have been subject to abuse or unauthorized repairs. Warranty with respect to products, components and accessories not manufactured by STOW is limited to the warranty extended by the manufacturer of those items. Engine/Motor manufacturers are responsible for engine/motor warranties. There are no warranties, express or implied, in addition to the above except as may be provided in writing by STOW. STOW shall not in any event be liable for any special indirect or consequential damages. The foregoing warranties are in place and in lieu of all warranties of merchantability and fitness and sets forth the entire obligation of STOW. To avoid misrepresentations with respect to products sold hereunder, the Dealer agrees that no warranties, or other operating guarantees on any products covered by this agreement shall be made in excess of those made by STOW.
